In the current economic climate, many homeowners are struggling to pay mortgages on their homes. To make matters worse, many can’t sell their homes for the amount of money that they owe on the home. Many homeowners are “under water”. When a homeowner struggles to pay the monthly note, has tried selling the home, but the home is underwater, they do have another option, as they can apply for a short sale. What is a short sale? In a nutshell, the lender takes the primary “hit” on the home, not the seller. A short sale is when the lender accepts less on the home then what the home is worth. The lender writes off the debt. Why would a lender accept less then what is owed on the home? It is generally not in the best interest of the lender to accept less then what is owed on a home, as banks are in business of loaning money, and collecting payments. However, it is expensive to foreclose on a home. First, the lender must wait a period of time before they “can” foreclose, dependent upon laws in each state. Second, it costs money to proceed with a foreclosure, and by the time the bank forces the homeowner out of the home, the costs can be extreme. Banks would rather avoid this process. How does a homeowner convince a bank to accept a short sale? The bank must be convinced that you cannot make payments on the home, and foreclosure is inevitable, if they don’t work with you. This means that you must be behind on your mortgage payments. The homeowner should work with a Realtor, and apply for a short sale. This means that you must have a buyer that is willing to step in,and negotiate a price, less then the amount owed on the home. You won’t convince a bank to accept a short sale without a buyer. How much less will the bank accept? This will depend upon the buyers offer, and how much you owe, and how willing the bank is to accept the lower payment. How do you start? Begin by finding a Realtor, and then place your home for sale, and try to find a buyer. When you find a buyer, willing to pay less than what is owed on the home, the Realtor will present this offer to the bank. If the bank accepts the offer, the game is over. You get out of the home, without destroying your credit. The lender gets to avoid foreclosure, and has a buyer willing to accept payments. Selling your home “short” will impact your credit, but it can be repaired faster then letting the home go back in a foreclosure. It can be a “win” for the lender and the homeowner, and frequently the buyer finds a “great” deal. It is far better to get out of a home through a short sale, then through the foreclosure process. When considering a short sale, place home on the market with a Realtor, and begin the process. Then sit back and wait for an offer that you can present to the bank; that hopefully the bank accepts.
